The first session of the third Nairobi Assembly will take place on September 9, 2022 if the newly elected governor accepts and publishes the proposal.
In the legislature, the Azimio Coalition enjoys a majority of seats having bagged 39 seats compared to Kenya Kwanza’s 37.
There are 122 members of the Nairobi County Assembly (MCAs), of which 85 are elected with the remaining 37 nominated to the house.
The meeting should be held no later than 30 days following the General Election in line with standing regulations.
The Governor-elect, Johnson Sakaja, is required by law to publish the meeting’s minutes and must approve this. By which period the names of the elected and nominated members should have been published by the Independent Electoral and Boundaries Commission (IEBC).
“The Governor by notice in the Kenya Gazette and the County Gazette, shall appoint the place and date of the first sitting of the new County Assembly,” the Nairobi City County Assembly Standing Order 4 (1) states.
The United Democratic Alliance (UDA), led by Ruto, holds the majority, with 36 seats, followed by Raila’s ODM with 35, President Uhuru Kenyatta’s Jubilee Party with five, Wiper with four, Chama Cha Kazi with one, and independents with two.
Elections for the Kwa Njenga Ward in the Embakasi South sub county, which were delayed by the IEBC due to the death of one of the candidates, have not yet been held and has since been postponed indefinitely.
The election of the speaker and the swearing-in of members are the only two items on the order paper for the first session, according to the Standing Orders.
The clerk in this case, Edward Gichana, would be required to read the County Assembly convening notice that was published in the Kenya Gazette during the meeting. Additionally, Gichana will place a list of the members’ names on the assembly’s table.
“The clerk shall administer oath of office provided for in the First Schedule of the County Governments Act, 2012 to all the members present,” reads the standing orders.
The clerk will declare the speaker’s position vacant and invite anybody who is interested to apply after the governor has gazetted the date of the first session.
