Matiang’i snubs DCI Amin, lawyer says his client was not summoned

The embattled former Interior Cabinet Secretary Fred Matiang’i today snubbed summons issued by the Directorate of Criminal Investigations (DCI).

Instead, his lawyer Danstan Omari while addressing the media at the Milimani Law Courts said the summon letter by the DCI Director Amin Mohamed’s office making rounds on social media is unsigned and has not been received by either the former CS or his lawyers hence lacks authenticity.

The lawyers insist that their client cannot be arrested.

“Show me a letter where police have signed and witnessed…. A proper summon must be signed and witnessed by police officers, show me one where the police have signed the summons…. A summon must be signed,” said Omari.

The DCI summoned his former boss yesterday to appear before the office this morning for grilling over alleged police raid at his home which the DCI and respective police and investigating agencies have since dismissed as falsified claims.

Through a statement, Serious Crime Unit boss Michael Sang was particular that he has reasons to believe that Matiang’i, is connected to the offence or has information which can assist him in his investigations.

The legal team representing the besieged Matiang’i want a summon with at least three signatories adding that if their client is served personally as is required by law, then they will definitely appear at the DCI.

“Any narrative that he has denied to attend to the summons is hot air, show us the signed summons and the DCI must sign the summons.” Omari added.

Additionally, he said the court order obtained does not stop investigations and that their client has not defied any orders as he clarified that the orders extended yesterday do not stop the former CS from being investigated but the investigations must be done within the law.

“Show me the summons signed and Matiangi or his lawyer have put a sign the media was cheated to depict the CS has been summoned,” reiterated Omari.

The lawyers have pointed an accusing finger to the DCI director Amin Mohammed accusing him of his mode of operation as incompetent and called on him to sign the alleged summon based on section 52 of the constitution.

The lawyers said if their client is summoned procedurally, he will comply insisting that the court can issue warrant of arrest in case of failure of compliance.
