Magistrate turns away DCI officer for presenting murder suspect in court wearing a borrowed trouser

Murder suspect Augustine Neto Amwayi told Senior Principal Magistrate Joseph Karanja that he wore a trouser he borrowed from a fellow inmate and the owner was to take it immediately after the suspect left the courtroom

Dramatic scenes played out at Makadara Law Court after a Magistrate turned away a Directorate of Criminal Investigations (DCI) officer who brought murder suspect to the court to seek custodial orders after the suspect told the court that he wore a borrowed trouser and risked walking half naked after leaving the courtroom.

Murder suspect Augustine Neto Amwayi told Senior Principal Magistrate Joseph Karanja that he wore a trouser he borrowed from a fellow inmate and the owner was to take it immediately after the suspect left the courtroom.

Amwayi told the court that he risked walking half naked. Additionally, the suspect claimed the trouser he wore was not gender appropriate.

But detective constable Neville Mwabili of Buruburu DCI offices told the court that Amwayi’s trouser has been kept as exhibit because it was found with blood stains of murder victim allegedly killed boy Amwayi.

Amwayi was arrested on Thursday last week after allegedly stabbing his ex-lover Felister Kalekye Kitua four times killing her instantly at her shop near Uhuru Market along Jongoo Road.

Mwabili was seeking orders of the court to detain Amwayi at the Buruburu police station for 21 days pending investigations into the murder of Kitua.

But the magistrate stood down the detective who had taken to the stand to take oath and make the application.

Karanja said the actions of the DCI admitted by Mwabili were not justified as the police should have bought a trouser for the suspect or make arrangements with his family for him to get another one.

Amwayi’s trouser has been handed over to the government Chemist for the government scientists involved in the investigations to conduct a DNA analysis and determine whether the blood on the trouser matches with that of the deceased.

The trouser and the DNA analysis report are going to be used as exhibits in the case against Amwayi.

The magistrate gave the DCI one night to find a trouser for Amwayi to guarantee his dignity first, and present the suspect in court on Tuesday June 10, 205.
