Lunga Lunga Police Station OCS ordered to take suspect to hospital injured while resisting police ‘abduction’

A Makadara court has ordered the officer commanding (OCS) Nairobi’s Lunga Lunga Police Station to escort a suspect injured by police officers during a fight with the cops inside his house while “resisting abduction” to hospital for treatment.

Senior Principal Magistrate Joseph Karanja directed the station commander to escort Kelvin Wapopa to Kenyatta National Hospital after the suspect claimed he was tortured by the police during the incident.

“To me it was abduction because none of them was in uniform and they did not produce anything to show they were police officers,” Wapopa told the court.

Wapopa is facing charges of possession of government stores to wit a pair of handcuffs belonging to the Administration Police Service (APS) – property of the government of Kenya reasonably suspected to have been stolen or unlawfully obtained.

The suspect is also facing two charges of assaulting police officers in execution of their duties contrary to section 103 (a) of the National Police Service Act.

In the charge, he is accused of willfully assaulting Corporal Makokha Asera and Police Constable Suleiman Ali within Sinai Kaiti within the Lungalunga slums, Makadara Sub County on June 10, 2025.

But the suspect told the court that he resisted abduction because the three officers who went into his house were not in uniform and declined to show him their certificates of appointment (COA) with NPS.

Wapopa said the only crime he knew was failure to give his girlfriend “fare” and told the court that police finally told him that they will accuse him of possession of handcuffs because he had given them a hard time.

He had overpowered the three officers who had initially gone to his house prompting them to call for reinforcement and their four colleagues showed up.

The suspect told the court that the officers had stripped him naked and a neighbor recorded a video of the incident during the commotion.

Prosecutor Allan Mogere had disputed Wapopa’s claims because the officers were to arrest him after an altercation with his wife before they found handcuffs in a bag in his house.

But Karanja said “from what is happening in our country, the claims (by Wapopa) are not far-fetched. They (police) went to arrest him and just found cuffs?

Karanja said the court had a duty to ensure the suspect’s rights by virtue of being the first court where the claims arose.

Police officers had met a village elder escorting Wapopa’s wife who had claimed she had been assaulted by the suspect and the cops went to the suspect’s house where the incident took place.

The matter will be mentioned on Monday June 16 when the suspect will be returned to court with evidence of having received appropriate treatment.
