Billionaire lawyer Murgor to sue NCBA Bank for erroneous CRB listing over Sh1,300 Fuliza loan

Billionaire lawyer Philip Murgor has accused NCBA Bank for erroneously listing his name on the Credit Reference Bureau (CRB) over Sh1,300 fuliza loan.

Murgor accused the bank of failing to verify information before listing him with CRB as a loan defaulter.

“NCBA at all material times, failed to exercise reasonable skill and care before forwarding the false reports about our client for publication and general circulation, as it took no steps to ascertain whether or not our client had indeed opened, or operated a Fuliza overdraft account. A preliminary and even casual enquiry would have confirmed that our client was not the legitimate owner of mobile number (withheld), and that he has not obtained a Fuliza overdraft facility under the said mobile number,” Murgor says in his letter to NCBA.

This follows Murgor’s application for a Sh403,000 loan from NCBA to pay for insurance premiums for his law firm, Murgor and Murgor Advocates that was rejected due to a Sh1,300 fuliza loan.

An NCBA agent had called him to inform him that his request was not approved due to the fuliza debt and would only be processed if the debt was paid in full.

The agent however did not disclose which institution had listed him despite his request for more information.

According to NCBA, the phone number registered to the Sh1,300 loan dispute was done using Murgor’s identification documents which Murgor insisted wasn’t.

NCBA however claimed that at the time the fuliza loan was disbursed, the phone number was registered in Murgor’s name.

Murgor applied for a credit report from Metropol Corporation Limited, which showed that it was NCBA that had listed him negatively over the Sh1,300 overdraft that he never took.

Murgor claims that the bank failed to provide him with the information he sought which triggered his move to take legal actions.
