Judge Chitembwe says Sh770,000 confiscated by DCI was son’s tuition fee

High court judge Said Juma Chitembwe has said that the Sh770,000, which was confiscated by detectives was his son’s tuition fees.

The Sh770,000 which was recovered in US Dollars, was intended for his son’s Australian school fees.

According to an affidavit, Justice Chitembwe claimed that he had custody of the funds since July 20 this year because he could not transfer the funds straight to his son’s University tuition account as he had requested.

“I was waiting to find time and go to the bank for help and advice on how to transfer the money directly to the university as requested by my son when I was unceremoniously and embarrassed , roughed up and arrested within the court premises for no crime at all,” Chetembwe explained.

“As a family we have kept a dollar account under my wife’s name for over three years and as such it’s not unusual or  suspect for me to have US Dollars in my possession as its proposed by the DCI.”

The judge claimed that he was never told what crime was being investigated against, who his accusers were, why his chambers were invaded and searched without a warrant.

He argued that he gave the money to the officers after seeing them conduct a body search on Justice Agrey Muchelule in order to avoid the officers’ misrepresentation.

In the affidavit, the judge said that he was ordered in unruly and undignified manner, frog marched by the DCI officer from the high court to the DCI office.

In an affidavit filed in court , the Directorate of Criminal Investigations (DCI) through Chief Inspector Felix Karisa Banzi claimed that they recovered USD 50,000 from an unidentified lady in Justice Muchelule’s chambers and a further 7,000 USD from Justice Chitembwe.

However, lawyer Danstan Omari said the detectives were searching for money but did not find a single penny in an inventory filed in court last week.

“That the search at chambers 230 and on the person of the occupants resulted to seizure of among others…..USD 50,000 on the person of a lady present in the chamber and USD 7,000 on the person of 2nd interested party himself,” the affidavit reads.
