Indian city tycoon accused of assaulting private guard in Kileleshwa yet to record statement

A private security guard attached to Steward International Security Services Limited who was allegedly assaulted by an Indian city tycoon in Nairobi’s Kileleshwa area could be forced to wait longer for justice to be administered days after reporting the matter at Kileleshwa Police Station.

Taberias Atuta Momanyi, a private guard stationed at Vasudev Heights apartments along Siaya Road in Kileleshwa filed an assault report against Maru Kishar last week on Wednesday April 12, 2023 but the accused is yet to be summoned to record a statement in connection to the incident.

Further, the security firm representatives who seemed to throw their employee under the bus possibly to safeguard the contractual business they have with the accused who is a private property developer said they are handling the matter internally but their employee is “free to pursue the case at the station if he so wishes.” A representative of Steward Security only identified as David told The Informer Media Group through a telephone conversation.

David spoke to us using Maru’s phone who were together at the time when we called Maru for comment over the matter.

On his part, in what points to a deliberate cover-up attempt, Maru said the complainant is a serial irritant and that his office (employer) is handling the matter.

Speaking to us on phone, Maru claimed he only pointed at him in an altercation for not delivering a parcel sent to him from the United States of America (USA) as instructed.

However, according to a CCTV footage in our possession, Maru is seen violently pushing and punching the victim.

Atuta is seen walking away slowly as his colleagues watched the ensuing dramatic scenes.

“He has wrongly written the statement. I have not beaten him.” Maru told us on phone.

According to eyewitnesses, the controversial tycoon retorted at the security officer before spewing unpalatable words at him.

He then punched and pushed private guard who is said to have restrained himself from fighting back and just blocked the punches.

“He came and angrily started insulting the security guards. He uttered racists comments which were unfortunate. The incident happened shortly after 2.30pm yesterday.” Our source intimated.

“The accused is yet to be summoned to record the statement seven days after the case was reported. We read malice or deliberate attempt to cover-up this matter.” Another source added.

In 2012, former Deputy Chief Justice Nancy Baraza resigned after a tribunal recommended her sacking for pinching a security guard at Village Market in Nairobi and allegedly threatening to shoot her.

According to Rebecca Kerubo, the former the judge had pinched her nose and pulled out a gun after refusing to be frisked at a shopping centre on New Year’s Eve.

The seven-member panel, headed by Tanzania’s former Chief Justice Augustino Ramadhani, agreed with the guard’s account of events at the Village Market shopping centre.
