Dutch fugitive wanted back home to serve jail term for sexual offences arrested

The respondent was convicted on December 28, 2020 and sentenced to serve 900 days imprisonment by the District Court in Limburg.

The Directorate of Criminal Investigations (DCI) has managed to arrest a Dutch fugitive against whom a Nairobi court issued a warrant of arrest to facilitate his extradition to serve a jail sentence for sexual offences.

Police superintendent Evelyne Mboya, who is attached at the DCI Headquarters Anti Human Trafficking and Child Protection Unit, produced the fugitive before Milimani Chief magistrate Lucas Onyina early today.

The officer informed the court that she arrested Jan Jacobus Brouwer yesterday in Mombasa’s Zawadi estate in Utange where he was residing in a rental house.

Prosecuting counsel Vincent Monda last week told the magistrate that they received a plea from the Public Prosecutor in Zwolle, Netherlands seeking their assistance to arrest him on December 17, 2024.

Monda added that on December 17, 2024, they received additional materials from the Public Prosecutor in Zwolle, Netherlands to issue arrest warrant.

The respondent was convicted on December 28, 2020 and sentenced to serve 900 days imprisonment by the District Court in Limburg.

He appealed the case and it was dismissed by by Den Bosch Court of Appeal on December 21, 2021, the official notice of the judgement was served in person on the respondent in Mombasa, Kenya and he had 14 days to file an appeal in cessation against the judgement which he failed to lodge by himself or through his representatives hence the sentence has deemed irrevocable as per June 10, 2023.

The defence lawyer Thomas Balala told the magistrate that his client has a serious health condition where he needs the attention before the proceedings on the hearing,

“Your honour my client is suffering from a serious health condition which needs immediate attention,” Balala prayed.

He urged the court to release the fugitive on bond to seek medical attention

Monda prayed the court to detain the suspect for the medical purposes before resuming on the hearing of bond plea awaiting extradition.

In giving directions on the matter, the magistrate ordered Jan to be detained at Capitol Hill police station for five days for the purpose of attending medication,

“The order is hereby granted for the respondent to be detained at Capitol Hill police station for five days and be escorted for medication,” the magistrate directed.

The matter was scheduled for mention on January 28, 2025 for further directions.
