Inspector General of Police (IG) Hillary Mutyambai has been ordered by Director of Public Prosecution (DPP) Noordin Haji to launch an investigation into the death of Daniel Musyoka, the electoral agency Returning Officer killed in the line of duty.
Haji also ordered the police boss to submit the findings for consideration within seven days.
“You are hereby directed to undertake comprehensive investigations into the matter contained in the statement by the IEBC Chairman under Article 157(4) of the Constitution of Kenya 2010, and submit the resultant investigation file within seven days of the date hereof,” read part of
the DPP’s statement.
Musyoka, the Returning Officer for the Embakasi East Constituency, went missing on August 11 at 9:45 am and his body was discovered by herders four days later in a river near the Kilombero Forest in Oloitoktok on Monday night, on August 15, 2022, in Loitoktok, Kajiado County.
This comes after Independent Electoral and Boundaries Commission (IEBC) Chairman Wafula Chebukati called for prompt investigation into the murder.
“As the Commission condoles with the family of Musyoka, we call on security agencies to speedily investigate and apprehend his killers,” said Chebukati.
His sisters, Mary Mwikali and Ann Mboya identified the 53-year-old’s body at a nearby morgue in Loitokitok.
Five pathologists who were working on the post-mortem on Wednesday were unable to determine Musyoka’s cause of death.
The group consented to collect 12 samples from the corpse for additional analysis in Nairobi.
Since then, the Law Society of Kenya (LSK) has committed to assign a lawyer to Musyoka’s family to assist with the ongoing investigation.
“We will follow up on the investigations to ensure full accountability for this senseless and heinous death,” said the Society’s President Eric Theuri.
In addition, Chairperson Chebukati claimed that during the incident involving the announcement of the presidential results on August 15, some of his commissioners, including Abdi Guliye, Boya Molu, and CEO Marjan Marjan Hussein, were physically attacked, assaulted, and hurt by individuals who were with other prominent political figures.
He urged law enforcement and prosecutors to speed up the investigation by holding all culprits accountable and making sure victims receive justice.
“We call for the arrest and prosecution of these assailants regardless of their political affiliation,” he said.
Musyoka was deployed at the East African School of Aviation Tallying Centre when he suddenly vanished after excusing himself to take a call and was never heard from or seen again.
