DPP granted two decide if to charge man accused of killing his wife with murder

The suspect John Kyama Wambua did not object the plea by the prosecution to be detained for two more weeks but claimed police forced him to incriminate himself

The Director of Public Prosecutions (DPP) has been given two weeks to determine whether a man accused of killing his wife in Huruma Estate in Nairobi should be charged with murder.

Through state prosecutor Judy Koech, the DPP told the Milimani Principal Magistrate Caroline Nyaguthii that police have concluded investigations against John Kyama Wambua and forwarded the file for review.
“Your honour the officer Investigating the matter has confirmed to have concluded Investigations in the matter and forwarded the file to the DPP for review and decide on whether to prefer murder charges against the accused,” Koech said.
He prayed the court to grant two weeks to have the matter mentioned to give the DPP’s office time to peruse the file.
On his part, Wambua did not object the plea by the prosecution to be detained for two more weeks.
“I do not object the prayers sought by the prosecution but I would wish to inform the court that I was forced to sign the statement presented before this court,” he told the magistrate.
The suspect told the court that the statement in the police file is not authentic since he was forced to sign by the officers from Huruma Police Station.
Though did not name the officers, the magistrate directed him to raise the issue after the perusal of the file if the decision to charge him will be grounded on his statement.
Wambua, 29, a carpenter, is suspected to have murdered his 19 year-old wife in Kasanova area in Huruma Estate, Nairobi on January 20.
According to the DCI report, Wambua said that he found his wife with another man and upon confronting her when they got to the house, an argument arose prompting him to commit the offence.
“That respondent alleged that he found his wife named Joy Fridah Munani (deceased ) with another man and when they got to house they argued and anger scaled leading  him to commit the act,” read the charge sheet.
DCI officer Kassim Yakub from Starehe Sub-County confirmed through the prosecution that they have concluded their investigations and handed the file to the DPP.
The matter will be mentioned in two weeks time.
