DCI, DPP Haji wars deepen over new regulations

The rivalry between Director of Criminal Investigation (DCI) George Kinoti and Director of Public Prosecutions (DPP) Noordin Haji has deepened with the former dissociating himself from terrorism guidelines launched by the prosecutorial agency.

According to court documents seen by The Informer, Kinoti and the Anti-Terrorism Police Unit (ATPU) said they shall never comply with the stated guidelines.

The guidelines launched by DPP states that the ATPU should notify DPP before making any arrests.

In addition, ATPU should also inform DPP when planning to apply for search warrants or detention orders against suspects.

Activist Memba Charo would move to court to challenge the said claims, saying the non-attendance of the investigative agencies was deceptive because the agencies were not recognised nor mandated by the laws of the Republic of Kenya.

Lawyer Danstan Omari who represented the activist Memba Ocharo, claimed the developed guidelines were allegedly developed with a technical committee composed of the relevant criminal justice system actors.

Omari sought an order to suspend the implementation of said guidelines pending the hearing and determination of his case saying DPP can only direct the Inspector General of Police to investigate.

Kinoti in response to the suit claims reiterated he is the chief principle in regard to the enforcement and investigation of terrorism and terrorism-related cases.
