Court to rule on whether Kamiti warder accused of mutiny will be granted bail

Kamiti Prison warder Jackson Kuria Kihara has been arraigned to face charges of making inciting and mutinous publications which is against the law.

The police, who arrested Kuria at the prison yesterday, sought to continue holding him for 21 days to give the officer investigating the matter tome to conclude Investigations and preferred charges against him.
Kuria, who shot to the limelight after he joined the Gen Z protests against higher taxes, was booked at Muthaiga Police Station after being interrogated at Mazingira House, the DCI headquarters.
The investigating officer, Meshack Mutinda, through state prosecutor James Gachoka told Milimani Chief Magistrate Lucas Onyina that he is investigating a case of false publication in Twitter accounts of the suspect, which is inciteful and mutinous.
He added that he needs to subject his social media platforms to forensic investigations which could take time.
Mutinda also indicated that preliminary Investigations reveals that Kuria has been using the name Shakur the Cop on his account to post information meant to be insightful and false.
He said that he wants him detained to make sure he does not interfere with the account an act which can tamper with Investigations.
The officer urged the court to grant him the time to adequately analyse the data which might took time since the posts are in his various social media platforms
He claims that the accused being a disciplined officer with capability of using various firearms he might interfere with investigations.
The defence lawyer James Ong’amo, however, opposed the application by the prosecution by stating that the police have not indicated how they need his involvement directly for the investigations to be completed.
He told the court that the respondent was arrested yesterday at 7 am and kept in custody for more than 24 hours before presenting him in court today at 1:00PM.
Further, he told the court that his client was denied his right to counsel where he has been frustrated by police officers denying him access,
“Your honour I have been frustrated by the officer including the one Investigating the matter to access my client,” Ong’amo said.
The lawyer pleaded with the court to release his client on bond since no compelling reasons given by the prosecution to detain him.
Onyina adjourned the matter until 4 pm when he will determine the bail application.
