Court to decide on Monday whether to release Waititu pending appeal

Lawyer Danstan Omari said that they had visited the former governor early today in Industrial Area remand prison and confirmed that he is still unwell

The High Court has directed the lawyers representing former Kiambu Governor Ferdinand Waititu to appear in court for the hearing of an application seeking his release pending appeal against his 12-year jail sentence.

Justice Lucy Njuguna directed the defence and the prosecution to appear before the court on February 24, adding that the relevant documents be served to the prosecution in the course of today, which should, in turn, file responses within three days.
“I hereby direct the defence to serve the prosecution with the documents by the close of today and the response should be filed within three days,” Justice Njuguna directed.
Waititu’s lawyers, Danstan Omari, Sam Nyaberi, Stanley Kinyanjui and Shadrack Wambui, welcomed the decision by the court, saying that the Judiciary has expedited its mandate in the case, a move likely to bring hope among citizens.
“The decision by the court to hear our application in that urgency is an act that will restore hope in the Judiciary,” Nyaberi said.
Omari said that they had visited Waititu early today in Industrial Area remand prison and confirmed that he is still unwell.
He added that the appeal application will be filed on Monday.
“The application for the appeal will be done on Monday and we have already prepared our grounds on that. We started with his release pending appeal and we can appreciate for that move and we are hoping the judge will consider our application,” Omari said.
