City politician Francis Mureithi off the hook in Sh615million fraud case

The High Court has dismissed a case in which an Ethiopian foreigner claims to have been defrauded a total of Ksh 615 million (US$ 4,921,500) by Nairobi politician Francis Mureithi.
In her judgement, Justice Frida Mugambi said the foreigner Herio Menkerios did not provide documents or evidence to prove his case hence it was dismissed.
Menkerios claims that he was defrauded by Mureithi after he was invited to invest the money in a business of supplying foodstuffs to the ministry of Defence with an assurance of being refunded within the agreed time.
He claims to have wired Ksh 244 million to Mureithi where they agreed the monies to be refunded with an interest of 18% per month which have accrued to Ksh 615 million from August 2017 until the payments were to be made in full.
In determining the matter, Justice Mugambi considered the submissions and evidence produced before the court by the parties and the key issue arose was the legality of the purported agreements entered in to by the parties.
She noted that the agreements at issue were a mere facade lacking any legitimate commercial purpose and “it is a well-settled principle in a law that a court cannot enforce rights arising from illegal contracts.”
In conclusion, she noted the case involved many illegalities and the court could assist the complainant to benefit from illegal transactions.
