Chickengate case against former IEBC CEO to be heard from July 3

The hearing of  the Chickengate case against former Independent Electoral and Boundaries Commission (IEBC) chief executive officer James Oswago, former commission official, Hamida Ali Kibwana, and an agent for a UK ballot printing firm, Trevy Oyombra was yesterday is set to kick off from July 3.

Milimani Anti- Corruption Senior Principal Magistrate  Magistrate Lawrence Mugambi fixed the hearing date after parties in the case that they were ready for the trial.

The three are facing charges for over Sh 50 million that was paid as bribe by a UK firm, Smith & Ouzman, to former members of the defunct Interim Independent Electoral Commission (IIEC) and the Kenya National Examination Council (KNEC) to award it a printing tender.

Oswago alone is accused of failing to comply with procurement laws.

The prosecution that on May 7 2010 at the IEBC offices Oswago being the accounting officer of the Interim Independent Electoral Commission, he awarded a contract for the supply of 57,000 ballot

papers for the South Mugirango by election to Smith and Ouzman Ltd which was in contravention of the Public Procurement and Disposal Regulations.

He faces another charge of receiving Sh 2 million from Hamida Ali Kibwana as an inducement to have the IEBC to award a contract for the printing of OMR corrections forms to Smith and Ouzman Limited.
