DPP seek to withdraw Sh7.5billion graft case against Gachagua
The Director of Public Prosecutions (DPP) Noordin Haji has sought to officially withdraw the Sh7.5billion graft case against Deputy President Rigathi Gachagua and nine others.
The DPP today told the Milimani Anti-Corruption Court that the decision was made because there was not enough evidence from the Directorate of Criminal Investigations (DCI) for prosecution.
Further in the application, the prosecution said it would be prejudicial for the case to continue as it is, as the evidence provided does not meet the required threshold for Gachagua to be successfully prosecuted.
The court will tomorrow rule on whether it will grant the DPP’s request.
Gachagua, who was the then Mathira Member of Parliament is facing six counts of conspiracy to commit economic crimes alongside William Mwangi, Anne Nduta, Julianne Jahenda, Samuel Murimi, Grace Wambui, Lawrence Kimaru, Irene Wambui and David Nguru.
The charges stated that between 2013 and 2020, Gachagua fraudulently received Sh7,330,011,265 through three bank accounts registered under his name domiciled at Rafiki Micro-Finance Bank while knowing they formed part of the proceeds of crimes.
