Anti-corruption case against two Nairobi MCAs adjourned

An anti-corruption case facing two Nairobi MCAs has been adjourned after a defense counsel  failed to attend court.

Maringo-Hamza ward representative Njuguna Mwangi and Komarock counterpart Samuel Irungu are charged with  soliciting and receiving bribes amounting to sh 680,000 from Philip Kilonzo.

The two were accused of demanding bribes as inducement to save stalls at Saika Market from being demolished.

The prosecution claims that the two received the money on August 14 at Ankara Restaurant.

A sting operation by the Ethics and Anti-corruption Commission (EACC) netted  the MCA’s after reports were lodged on  August 13  2013.

The prosecution has listed 8 witnesses in the matter.

The MCAs face  two counts of “corruptly soliciting” and a third on corruptly receiving a benefit, contrary to sections 39(3), and 48 (1), the Anti-corruption and Economic Crimes Act (ACECA) no. 3 of 2003.

Njuguna and Iringa have since denied the charges and are out on a Sh 100,000 bail each.

Although Prosecutions was ready to proceed with the matter, defense counsel for the first accused failed to appear in court.

The trial magistrate Felix Kombo has been put off the case  to  May 4 and 5 2017.
