The supreme Court has restricted friends of court to only participate in the hearing process of the presidential results petition through written submissions and not oral submissions unless requested by court to participate as interlocutory applications.
Deputy Chief justice Philomena Mwilu while delivering the ruling on the nine issues raised during the morning session urged the parties to abide by the ruling.
“…friends of court have been restricted to written submissions and not oral submissions unless requested by court to participate as interlocutory applications,” stated Mwilu.
The law states that written submissions shall be contained in one volume only, whose length shall be in appeals arising from the Court of Appeal decisions, submissions shall not exceed fifteen pages.
Additionally, it states that in matters where the Supreme Court has original jurisdiction, submissions shall not exceed thirty pages.
Over 20 interlocutory applications had been submitted before the apex court.
The Supreme Court declined the first declaration of the nine accounts which is whether the technology deployed by IEBC met standards of integrity, verifiability, security and transparency to guarantee accurate and verifiable results.
The court has further allowed late applications submitted by 2:00 pm August 29, 2022 to be used during the hearing process.
Further, the court declined request for additional time over and above the allocated time for petitioners and respondents respectively. Moving forward, the court will not entertain any extra affidavits.
The notice by Issac Mansur to represent four Commissioners are at liberty to be represented by Mansur and Paul Mwite.
The Supreme Court strike out the appointment of Issa and Co. Advocates by four of the IEBC Commissioners led by Vice-Chair Juliana Cherera opposed to the presidential election results to represent the Commission. The 4 Commissioners had purportedly appointed the counsel to act on behalf of the IEBC allowing them to be represented individually.
The seven-judge-bench team has also directed Director General of police to provide adequate security to all the electoral body commissioners.
