CJ Koome swear in tribunal to probe justice Chitembwe

Chief Justice Martha Koome has today sworn in a seven-member tribunal tasked with investigating suspended High Court Judge Said Juma Chitembwe.

The seven-member team comprises Justice Mumbi Ngugi who will chair the committee and will work alongside Lady Justice Abida Ali Aroni, Justice Nzioki wa Makau, James Ochieng’ Oduol, Lt. Gen. (Rtd.) Jackson W. Ndung’u, Dr Lydia Nzomo and Dr Fred Ojiambo.

While swearing in the team, Koome appealed to the seven-member team to expedite the hearing and uphold justice while adjudicating their duties.

In a gazette notice dated May 18, President Uhuru Kenyatta appointed a 12-member team to inquire into the allegations against the judge and determine his suitability.

Justice Cimambwe’s suspension came after the Judicial Service Commission (JSC) recommended to the president to form a tribunal to probe the judge’s conduct in line with the Constitution.

The President noted that the JSC petition contained grave allegations against the judge and that it could potentially erode Kenyans’ faith in the fair administration of justice.

On November 22, 2021, the JSC initiated proceedings against Chitembwe after Sonko released video clips, social media posts and cell phone recordings implicating the judge in corruption.

The tribunal will make a finding on whether to recommend Chitembwe’s sacking or he is reinstated.

A complaint had been lodged against Justice Chitembwe in November 2021, detailing allegations of misconduct to support his removal.

Chitembwe at the time dismissed the allegations saying that he was unfairly targeted.
