Businesswoman Mary Wambui and her daughter Purity Njoki Mungai can finally breathe easy after the court allowed the Director of Public Prosecutions (DPP), Noordin Haji withdraw the Sh2.2billion tax evasion case against them.
This follows the DPP’s application for the charges to be dropped under Section 204.
In a judgment delivered by Chief Magistrate Felix Kombo, lawyers representing the two, Nelson Havi and Adrian Kamotho did not object to the withdrawal application.
“We are in agreement that this is a matter that should not have reached at the stage…of prosecution…it’s an anguish she has had to endure a lot of difficulties including denial of certain rights”, said lawyer Kamotho.
Kenya Revenue Authority made the decision to withdraw the case following successful compounding of offences on December 6, 2022 and the subsequent payment of the fines imposed.
Wambui and her daughter Purity who are both directors of Purma Holdings were charged with eight counts of fraud, for deliberately omitting taxes due in the income tax returns submitted to the Commissioner for Domestic Taxes for the period between 2014 to 2016.
