The Director of Public Prosecutions (DPP) has applied to withdraw the Sh80 million graft case against former Samburu Governor Moses Lenolkulal.
Magistrate Thomas Nzioki has however declined to withdraw the charges stating that prosecution must give justifiable reasons as to why Lenolkalul should be cleared.
Ethics and Anticorruption Commission (EACC) filed the petition in September 2019 on grounds that Oryx Service Station, a company allegedly registered under the governor’s name, received Sh.80,715,000 in county funds between 2013 and 2018.
“Prior to the institution of the suit the commission froze Sh.14 million and properties in Karen, Nairobi purchased for Sh. 60 million which were determined to have been purchased with funds from the illegal contracts founded on conflict of interest,” EACC said in a past statement.
Nzioki has asked Noordin Haji to file an application justifying why he wants to terminate the case.
