The Director of Public Prosecution, Noordin Haji has today withdrawn Sh400 million graft case against former Kenya Power Managing Director Ben Chumo and ten others.
Haji discharged them under section 87 (a) of the Criminal Procedure Court (CPC) citing underwhelming evidence with 3 of 4 witnesses examined.
Chumo and his fellow executives were accused in 2018 for entering into a contract with a private firm for the supply of transformers worth Sh400 million which were faulty.
Muwa Trading company directors, James Njenga Mungai, Grace Wanjira Mungai and John Mungai were also charged alongside Chuma but had their case withdrawn last year.
The company allegedly supplied the faulty transformers.
Chumo and the other former directors however denied charges of conspiracy to commit an offence, aiding the commission of a felony, intentional failure to comply with procurement laws, conspiracy to defeat justice and fraudulent acquisition of public property.
