The Nyamira County Assembly Appointments Committee has approved James Gesame, former West Mugirango Member of Parliament as Deputy Governor.
This comes after the High Court dismissed a case that was filed barring his nomination and approval as Deputy Governor last month.
Majority Leader Duke Masira presented the report of the Committee to the County Assembly for approval and all 36 MCAs voted for the approval of Gesami as the Deputy Governor.
“The County Assembly, in its Special Sitting of Monday, 9th August 2021 has considered and approved the Report of the Committee on Appointments on the Vetting of Dr. James Ondicho Gesami Nominee for Deputy Governor – County Government of Nyamira,” said Speaker Moffat Teya.
According to the report, Gesami had all the necessary documents including academics, clearance from CRB, EACC, HELB, good conduct as well as clearance from ODM party as a member.
An order stopping his nomination was issued on May 27 this year hours to the second vetting of Gesami by the County Assembly’s appointment committee.
“It is hereby ordered that the interim conservatory order be and is hereby issued staying the process of nomination and or processing a nominee to the office of the Deputy governor, county government of Nyamira pending the hearing and determination of the application,” stated the initial order.
The judge said the petitioner did not demonstrate a prima facie case with a likelihood of success as would warrant the court to grant the said conservatory order.
“I am also persuaded that the grant of a conservatory order would serve the public interest, as in my view that interest would be served by a purposive interpretation of the law as opposed to a narrow and a restrictive interpretation.”
“Further the petition, any other prayers and it’s substrum will definitely not be rendered nugatory by refusal to grant conservatory orders. In the premises, the application is dismissed with costs to the respondents,” stated part of the ruling issued by Nyamira High Court judge Esther Maina.
Governor Nyaribo re-submitted the name of Gesame for vetting as his Deputy Governor after the assembly previously rejected his nomination on grounds that he had not submitted crucial documents.
