Court to rule on exclusion of IEBC leadership to handle repeat presidential poll

The High Court will give directions on the urgent petition seeking the exclusion of the Independent and Boundaries Commission (IEBC) leadership from handling the fresh presidential election that must be concluded by November 1.

The Supreme Court, which invalidated the August 8 presidential poll pitting President Uhuru Kenyatta and National Super Alliance (NASA) supremo Raila Odinga on the basis of irregular transmission of results, had directed IEBC to conduct the repeat exercise within 60 days in accordance with the Constitution and all relevant laws.

The target of the latest challenge to the controversial electoral process are the IEBC Chairman Wafula Chebukati, Vice-Chairman Consolata Nkatha, Commissioners Roselyn Akombe, prof Abdi Yakub Guliye, Margaret Wanjala Mwachanya, Paul Kurgat, Boya Molu and Chief Executive Officer Ezra Chiloba.

The petitioners-Brian Asin, Ben Wanasakaani and kevin Alwang’a-are seeking orders barring the even-member team from supervising and overseeing the repeat of the presidential election as ordered by the Supreme Court in its majority decision pronounced last Friday. they want the Chebukati team to be disqualified from holding public office in future.
