Miguna to obtain emergency travel document within 72 hours, court orders
The Canada-based Kenyan lawyer, Miguna Miguna has been directed to obtain emergency travel document from Kenya Embassy in Berlin or Ottawa within 72 hours.
The High Court also directed Air France to allow Miguna to board an available flight to Kenya with immediate effect once he is in possession of the emergency travel document.
Giving the directives, Justice Hedwig Ong’undi ordered Miguna to be allowed to use his Identification Card on landing.
“Once in Kenya, Miguna should immediately apply for a Kenyan passport and the same issued to him within seven days as long as all requirements are complied with,” rurel Ong’undi.
Justice Ong’undi said Foreign Affairs Cabinet Secretary Raychelle Omamo must ensure the said order is complied with.
Interior Principal Secretary Karanja Kibicho denied existence of “Red Alerts” blocking lawyer Miguna Miguna from returning to Kenya.
According to Kibicho, no government agency had issued any red alert to the Lufthansa Group and Air France in relation to Miguna’s return to Kenya.
In a sworn affidavit dated November 17, Kibicho asked the court to strike out the application saying it’s based on hearsay and inadmissible evidence.
However, the PS noted that Miguna had been advised to visit the Kenya High Commission in Ottawa and obtain an emergency certificate to enable him travel to Kenya.
The advisory followed a request by the National Commission on Human Rights to the Immigration Department seeking a passport to facilitate Miguna’s return home.
