Two men charged with robbing boda boda rider of his motorbike pretending to be victims of theft
The prosecution says the two were armed with knives and used actual violence on Muthama during the alleged daylight robbery
Two men, who allegedly robbed a boda boda rider of his motorbike while falsely accusing him of stealing from them and inciting members of the public against him, are facing charges of violent robbery.
Anthony Waithaka and Felix Kamau were charged with robbery with violence contrary to section 296 (2) of the Penal Code.
They are accused of violently stealing the motorcycle worth Sh161,000 belonging to Caroline Mikenyi which was in custody of her employee Stephen Muthama within the Bondeni area of Mathare in Starehe Sub County, Nairobi on July 15.
The suspects pretended that Muthama was stealing the bike from them and raised a fake alarm but fortunately, members of the public kept off.
The prosecution says the two were armed with knives and used actual violence on Muthama during the alleged daylight robbery.
But the two denied the charges when they were arraigned before Makadara Senior Principal Magistrate Joseph Karanja.
Muthama had dropped a passenger in the area before he was approached by a young man who took his bike’s ignition key before walking away.
The rider started pushing his bike from the scene but other men numbering around five confronted him while armed with knives and a commotion ensued before Muthama finally escaped, fleeing away to a safe place at a distance.
Muthama told the police during the investigations that he saw a man later identified as Kamau, one of the accused persons in the case, carry one of his accomplices as they left the scene.
The complainant had called for help during the incident but area residents and pedestrians looked on and others walked by as he was being assaulted during the robbery.
Muthama later reported the matter to undercover police officers on patrol who launched a manhunt for the suspects and arrested Waithaka who led the cops to Kamau and he was also arrested.
Karanja released the two on a bond of Sh300,000 each with a surety of a similar amount without the option of a cash bail. The case will be mentioned on September 4.
The motorcycle has not been recovered and police are looking for the other suspects involved in the robbery to prosecute them together with the two.
