Blow to Wanjigi as court dismiss his bid to be included in the ballot

The High Court has dismissed an application by Safina Party presidential aspirant Jimi Wanjigi to be included in the ballot.

Justice Jairus Ngaah denied the motion on grounds that Wanjigi had failed to persuade the court of his eligibility to run for office.

“In the ultimate, I am not satisfied that a case has been made out to persuade me to exercise my discretion in favour of the applicant and grant any orders sought,” the court ruled.

Wanjigi filed a petition following the Independent Electoral and Boundaries Commission’s (IEBC) decision to reject his bid to run for president in August polls due to lack of a university degree

Despite not having a college degree, Wanjigi had requested the court to order the IEBC chair, Wafula Chebukati, to allow him to run for president.

Wanjigi maintained that he had finished his coursework at Daystar University and would soon receive his diploma.

The businessman asserted via his attorney, Omwanza Ombati, that the IEBC was violating his rights because the Commission for University Education (CUE) had cleared him.

The Safina presidential candidate fought hard in court yesterday, working with his attorneys to persuade the judge that the IEBC Dispute Resolution Committee erred in dismissing his complaint.
