Supreme Court adjourn Sh2billion land case, demand exit of senior counsel Ahmednasir, his associates

The Supreme Court was today morning forced to adjourn a hearing after the defense legal team in the case involving Sh 2 billion case with the family of the late president Daniel Moi was being led by senior counsel Ahmednasir Abdullahi.

The apex court made good of its communique of declining to hear the senior counsel or any other gadget belonging to him following the case proceedings.

They adjourned the hearing with six judges recused themselves from the matter as long as Ahmednasir was the one in record.

During the virtual hearing, the court led by Chief Justice Martha Koome said that they would not proceed with the matter if Ahmednasir is part of its defense.

Ahmednasir was on January 18, 2024 barred from appearing before the Supreme Court, had appeared in court to represent a family in a legal battle over a Sh2billion land case with the family of the late president Daniel Moi.

However, in a quick rejpoinder, Ahmednasir alias Grand Mullah, took the refusal to his X account saying that he is willing to make peace with the Supreme Court only after the CJ and her deputy and judge Njoki Ndung’u are not part of the apex court.

He added that he would only appear or take a brief if justice Lenaola, Ouko and other new members constitute of the majority at the court.

“I will not take a brief or appear before the Supreme Court as long as CJ Koome, DCJ Mwilu, Smokin Wanja and Njoki are judges of the Supreme Court Kenya.” He said.

“I will come back to the Court (InshaAllah) if and when Justices Ibrahim, Lenaola, Ouko and other new members constitute a majority in the Supreme Court,” he outlined his ‘condition’.” He added.

The letter by the Supreme Court that is barring the Senior Counsel from appearing before it is now adopted as a court order.

“It is the decision of this Court, that henceforth and from the date of this Communication, you shall have no audience before the Court, either by yourself, through an employee of your law firm, or any other person holding brief for you, or acting pursuant to your instructions.” The letter to Ahmednasir on January 18 read in part.

The Supreme Court barred Ahmednasir on grounds that he has had continued attacks on judges and the judiciary.

The lawyer has since vowed to challenge the decision at the East African Court of Justice.
