IEBC quash Ekuru Aukot’s petition nullifying Raila from August polls

The Independent Electoral and Boundaries Commission (IEBC) has quashed a petition lodged by Thirdway Alliance party leader Ekuru Aukot nullifying the Azimio-One Kenya coalition party’s flagbearer Raila Odinga.

On behalf of IEBC Chairman Wafula Chebukati, Acting Director of Voter Registration and Electoral Operations Moses Sunkuli swore a replying affidavit.

Sunkuli claimed that no evidence has been produced to show that the accused is guilty of an election infraction and that Raila is a valid member of a coalition as defined by the Political Parties Act of 2011.

“The complaint filed is an abuse of due processes as the petitioner should have channelled them to the Electoral Code of Conduct Enforcement forum or by way of an investigation by the National Police Service,” read the affidavit in part.

Sunkuli went on to say that Aukot’s statements that Raila is supported by public funding were not taken into account during the verification and registration procedure.

Aukot contended in his petition that because Raila is a former prime minister, he is a public official and hence unqualified to run for president.

Odinga, according to Aukot, is a beneficiary of Parliament’s 2015 Retirement Benefits (Deputy President and Designated State Officers) Act.
