Nine DCI officers implicated in the suspected murder of two Indian nationals to be arraigned on Thursday
The nine Directorate of Criminal Investigations (DCI) officers of the disbanded Special Service Unit (SSU) implicated in the suspected murder of two Indian nationals and their taxi driver will be arraigned on Thursday when the court will rule on whether they should be detained as investigations on the case proceed.
An application filed at the Kahawa Law courts in Kiambu county before Chief Magistrate Diana Mochache argued that more time was needed to subject the suspects to a DNA test and analyse their mobile phones, which police claim incriminated the nine in the murder plot.
Mochache said the prosecution team had proved that it had been served with a replying affidavit to their miscellaneous application yesterday morning in court.
“It would be unfair in the pursuit of justice to deny the prosecution more days to file a replying affidavit to that effect. I therefore grant them three more days instead of seven,” she ruled.
Defence attorney Dunstan Omari had argued that if the prosecution could be granted more days to file replying affidavits, it would also be fair for the accused to be released on bail terms which the court however rejected his plea.
He had argued that the application filed by the National Police Service (NPS) through the Internal Affairs Unit (IAU) should not be merited stating that issues to do with police brutality should be dealt with by the Independent Policing Oversight Authority (IPOA) or the Office of the Director of Public Prosecutions (ODPP).
The nine are Peter Muthee Gachiku, Francis Muendo Ndonye, John Mwangi Kamau, Joseph Kamau Mbugua, John Mwendwa Mbaya, David Chepcheng Kipsoi, Stephen Luseno Matunda, Paul Njogu Muriithi and Simon Gikonyo.
