Petitioner moves to court seeking to be enjoined in Wanjigi’s fraud case

A petitioner of a disputed Westlands property in Nairobi yesterday moved to court seeking to be enjoined in a case in which businessman Jimmy Wanjigi obtained orders stopping his arrest and prosecution.

In documents filed in court, Cissy Kalunde stated that she is the registered land owner and it would be prudent that she participates in the case, adding that the parcel of land had been a subject of litigation before the Environment and Land Court.

“The participation of Kalunde in the current court proceedings is vital as she has an identifiable stake in the proceedings and a legal interest in this matter as the victim,” reads the court papers.

The petition comes weeks after Justice Antony Mrima issued orders restraining the State from arresting and prosecuting Wanjigi in relation to the property pending hearing and determination of a case he filed.

Through lawyer Danstan Omari, Kalunde articulates the orders issued restraining the Inspector General of Police and the Director of Public Prosecutions from arresting and prosecuting Wanjigi and Augustine Kairo Thuo were procured by misdirecting and withholding material facts from the court so as to protect persons who want to defraud her of the property.

She said the Directorate of Criminal Investigations had established that Wanjigi was part of a wider syndicate that had forged documents of ownership.

“DCI Report also revealed the existence of an intricate and wicked fraudulent scheme involving Wajingi and various accomplices, including police officers, lawyers, a sitting judge, officials at the Lands Registry and at the Companies Registry that was designed to defraud unsuspecting members of the public, including Kenroid Limited, and rob me of my property,” read court papers by Kalunde.

Wanjigi has refuted claims that his arrest was linked to land wrangles claiming it is on the basis of his presidential aspirations.

Earlier in January the business tycoon had been arrested and security deployed at his premises, it was alleged that part of the reason for the raid was a fraudulent land acquisition that also involved the businessman’s wife.

The businessman said the land in question, which is near his office, belongs to his wife who legally acquired it years ago.

He said his family had in 2018 made complaints about some individuals who wanted to take the land away from them.
