Fida opposes DPP decision to charge Murgor sisters in Ndichu twins assault case
The Federal of Women Lawyers (Fida-Kenya) has protested the Office of the Director of Public Prosecution (ODPP) decision to charge the Murgor sisters with assault and affray.
This is after the DPP ordered that all six individuals involved in the Ndichu brothers saga be charged saying that additional investigations shows that the complainants too had a case to answer.
In a letter to the assistant DPP, Fida questioned the new twist that has seen the victims becoming the accused persons.
“It is gravely concerning that our client’s rights as per article 157(6), (10) and (11) as enshrined in the Constitution have been blantantly disregarded and overlooked despite compelling evidence provided by our clients to carry out proper investigations and charge the perpetrators with the correct offence as per the penal code. Instead, we have been issued with counter accusations against our clients which we take issue with,” read part of the letter.
Fida wants a review of the decision to charge the sisters and the DPP to direct the police to conduct proper investigations on the matter.
In the new twist, Stephanie and Cheryl Murgor are being accused of assaulting Munira Hassan Mohammed, an associate of the Ndichu brothers on the night of the incident.
The DPP says CCTV footage obtained from the Ole Sereni Hotel had shown that both Chery and Munyra engaged in affray between 2:53am and 3:03am.
DPP also wants Edward and Paul Ndichu charged with malicious damage of property as at about 2:59am, the two are seen damaging the vehicle belonging to Samuel Ramdas who was with the Murgor sisters.
The Ndichu brothers are equally accused of assaulting both Murgor sisters, Samuel Ramdas and Patrick Koech between 2:51am and 3:02am.
Further, the DPP cites Paul Koech assaulted Munyra during the process of stopping the fight between her and Cheryl.
The DPP also wants Edward Ndichu and Koech charged with affray but if the charge is not sustainable, they be charged with assaulting each other.
In October, the two sisters lodged a complaint accusing the Ndichu of assault and the DPP directed that the Ndichu twins take plea which never took place.
