Court adjourn case against five DCI officers suspected of the disappearance of two Indians
A Kahawa court has adjourned a case against five Directorate of Criminal Investigations (DCI) officers who were arrested in suspicion of abducting two Indian nationals and their taxi driver.
Chief Magistrate Diana Mochache allowed an application by the five suspects namely corporals Joseph Mbaya, David Kipsoi, Stephen Matunda, Paul Muriithi and Simon Gikonyo against the state’s request to have them detained for 30 days to allow conclusive investigations.
The court was also requested to order DNA samples taken from the respondents for purposes of profiling and comparison with some recovered items believed to belong to the missing two Indian nationals.
The state, through SADPP Michael Sang and SPC Harrison Kiarie, is also seeking court authorisation to subject electronic gadgets recovered from the five detectives for forensic examination.
The five were arrested yesterday evening at the IAU headquarters in Nairobi’s Upper Hill area, where they were being held for interrogation.
“They are being investigated for the offences of conspiracy to commit a felony contrary to Section 393 of the Penal Code and abduction contrary to Section 254 of the Penal Code,” the National Police Service’s Internal Affairs Unit (IAU) stated in a notice yesterday.
The number of officers in custody over the matter now totals to nine, four of which including Peter Muthee, Francis Ndonye, John Kamau and Joseph Mbugua who were arrested five days ago.
The cas has been scheduled for hearing on October 31, when the court will hear the application by the counsel representing all nine officers.
