The Justice Aggrey Muchelule-led tribunal has declined an application by Azimio One Kenya coalition to be included in the ongoing proceedings involving the conduct of the four former IEBC commissioners.
Muchelule said that the application by the party, failed to show how it would suffer damages if not enjoined.
“Your application has not demonstrated that you will suffer prejudice if for instance this tribunal recommends the removal of the four commissioners,” Justice Muchelule stated.
“We don’t see how the outcome of the tribunal against Commissioner Irene Masit will affect Azimio. The proceedings of the tribunal are also time-bound. The work of the tribunal was also widely publicized, we don’t know why Azimio is making an application to be enjoined now,” he ruled.
The tribunal is investigating the conduct of the four former IEBC Commissioners namely Juliana Cherera who was the Vice Chairperson and Justus Nyang’aya, Francis Wanderi and Irene Masit who all disowned last elections presidential results moments before they were announced.
Former IEBC commissioners Abdi Guliye and Boya Molu already appeared before the tribunal yesterday while former IEBC chairperson is scheduked to appear before the proceedings today.
