Court bars businessman Rajab Ahmed Karume from evicting Insurance College in South C land row
The Environment and Land Court has barred private developer Rajab Ahmed Karume from evicting the Insurance Training and Education Trust (ITET) from its land in Nairobi’s South C area
The land is at the centre of dispute.
In a directive issued last week by the Environment and Lands Court, Justice Grace Kemei ordered the private developer Rajab Ahmed Karume to stop the erection of a perimeter wall on the said land.
“The application is hereby certified as urgent and an interim order is hereby given barring the Private developer from erecting a perimeter wall granting prayers number three and four of the application pending the hearing and determination of the case,” the court directed.
The developer is accused of grabbing five acres of land from the college.
While issuing the order, Kemei warned of disobedience by the private developer as she stated that non-compliance would result to a penalty being given.
The order came as relief for the insurance college which was seeking the court to suspend an earlier order that was issued in November of last year granting Rajab the possession rights of the contested five acres under LR number 209/10210.
The Institution which also operates the Edge Convention has been battling several attempts of land grabbing by private developers for over twenty years.
In the petition, the college argue that they have been exclusively owning the contested land since 1994.
The land has a playing ground with a guests parking area.
Through their advocate Kenvine Odhiambo, they wrote to Karume’s legal team Ahmednassir Abdullahi and Peter Muchoki notifying them of the directive issued by the Environment Court after armed goons stormed the college destroying their property.
Reports indicate that the construction works at the site had been set to begin with police officers from Akila Police station being accused of offering protection.
Early this month, Rajab had acquired an eviction order for the college.
