Activist Kiama released unconditionally over lack of sufficient evidence

Activist Edwin Mutemi Kiama has been released unconditionally after the prosecution failed to provide sufficient evidence for his prosecution.
Milimani court’s senior resident magistrate, Jane Kamau, today set the activist free and ordered that the cash bail of Sh500, 000 deposited in court be refunded back to him.
Kamau dismissed the application by the prosecution saying that the gadgets obtained from him had been taken to the Communication Authority of Kenya and the report had not been availed.
The gadgets include phones and laptops obtained from Kiama.
Kiama’s lawyer requested the prosecution to release the phones and laptops confiscated from his client.
On April 8,2021, human rights activist was arraigned in court for publishing false information and was released on a 500,000 shillings cash bail.
Kiama had also been ordered not to use his social media accounts and report to the investigating officer daily until mention of his case on April 20, 2021.
The court had also barred Kiama from mentioning the International Monetary Fund.
The two posters at the centre of his case had warned the International Monetary Fund (IMF) against issuing further loans to Kenya, more directly to the president and his deputy.
The investigating officer, Patrick Kibowen, said in an affidavit that he was probing possible offenses under the Computer Misuse and Cybercrime Act No.5 of 2018.
Investigating authorities say the information published by Kiama amounts to false publication.
The case will be mentioned on May 21.
