Court dismisses an application to withdraw criminal case against MP Babu Owino
A Nairobi court has declined the bid to withdraw criminal case against the Embakasi East Member of Parliament (MP) Babu Owino.
In the case, Felix Orinda alias DJ Evolve had written to the court, saying that he had forgiven Babu and wanted to focus on his healing.
Principal Magistrate Bernard Ochoi noted that unconditional withdrawal is not appropriate in the case where he is charged with shooting DJ Evolve.
“Unconditional withdrawal is not appropriate in the circumstances of this case; the parties must come out openly and tell court what Babu had offered the family,” Ochoi said.
The court further directed that Babu Owino to disclose what he has offered DJ Evolve’s family, noting that the court has not been told whether compensation has been made despite the serious injuries suffered by DJ Evolve.
However, Ochoi said he has not closed avenues for further engagements.
The MP was charged early last year with attempting to murder DJ Evolve at B-club. He is out on cash bail.
