Wife to the murdered Dutch tycoon Tob Cohen has obtained orders to personally take part in the autopsy examination of her late husband at Chiromo Mortuary.
Sarah Wairimu, through her lawyer Philip Murgor successfully applied to be part of the family in identifying the body a day after she objected participation of government pathologist Dr Peter Ndegwa citing possible partiality.
The production orders granted by the court have to be served to Prisons Department to facilitate her presence at Chiromo which is likely to take time a further delay the process for the second day running.
“I am happy to announce that we have obtained orders before High Court judge justice Stella Mutuku for Sarah Cohen to be present in this exercise. I remain hopeful the exercise will be conducted today,” Murgor said.
On Monday, Wairimu through her lawyer forced abrupt postponement of the exercise during a postmortem pre-meeting saying he’s impartial. Ndegwa had visited the scene at Cohen’s Kitusuru residence where his body was found dumped in a completely sealed underground water-tank.
Legally, there are three methods of identification notably; X-ray or Computed Tomography (CT) scan and scientific identification which involves DNA analysis.
Chief Government pathologist Johansen Oduor will be the lead pathologist assisted by family pathologist Professor Emily Rugane.
Professor Andrew Kanyi Gachie will be the defense pathologist who are already at the morgue.
Homicide detectives drawn from the Directorate of Criminal Investigations and officials from the Government Chemist are also present.
The X-Ray and CT Scan analysis on the whole body was conducted at the Kenyatta National Hospital.
They seek to establish if there are any injuries inflicted that cannot be seen merely through physical observation. Cohen’s body was found in an underground water tank within his Kitusuru residence in Nairobi after 42 days since he went missing.
His wife and Patrick Karanja have since been arrested and charged in connection to the murder.
