Five men implicated in abduction and defilement of a juvenile detained

A Nairobi court has ordered the detention of five male suspects for a period of five days to allow conclusion of Investigations relating with abduction and defilement of a juvenile female victim.

Police Constable Irene Karegi attached to the Directorate of Criminal Investigations (DCI) Kilimani, Nairobi urged the court to give her orders of detention to have the five suspects in custody as she proceeds with Investigations.

Patrick Kamau Muthee, Ian Chege, Ismail Mohamed Hammed, Adnan Hussein Jele and Abdirahman Mohamed Ahmed who were arrested on Wednesday, December 11, 2024 at Western Suit Apartment in an Airbnb in Nairobi West within Nairobi county are suspected to have abducted the juvenile and molested her sexually.

State prosecutor Judy Koech told the court that the complainant and the mother to the juvenile reported the matter of her missing daughter on December 7, 2024 at Kilimani Police Station after trials to trace her through her friends became futile.

The court heard that the Investigations led them in an Airbnb in Nairobi where the minor was rescued and five suspects who were linked with her disappearance arrested in the same house.

“During the time of the arrest, the respondents were in the same room with the juvenile and they all seemed to be under influence of drug abuse.” The DCI officer told the court.

Preliminary Investigations shows that the juvenile had been defiled.

The investigating officer prayed for custodial orders to enable them conduct the DNA sampling of the respondents.

The officer told the magistrate that they are yet to record statements from the key witnesses and Investigating their call data before and after the abduction.

They further intend to forward the file to the Office of the Director of Public Prosecutions (ODPP) for perusal and advice.

The defence lawyer for Ismail, Adnan and Abdirahman, Nancy Mukabana urged the court to dismiss the application by the state counsel stating that no compelling reasons were given by the applicant to detain them four 14 days,

“Your honour the reasons given are not compelling to detain my clients. The prosecution did not tell the court whether the accused persons are flight risk or whether they will interfere with Investigations.” Mukabana submitted.

The counsel told the magistrate that the suspects are Kenyan and are willing to abide with directions to be imposed by the court.

In his brief ruling, the magistrate considered the submissions by the prosecution and the defence and proceeded to grant an order for five days’ detention.

The matter will be mentioned on December 19, 2024, for further directions.
