DPP Haji on the spot over nepotism claims

An activist has moved to court to challenge the list of candidates for various positions in the Office of Director of Public Prosecutions (DPP).

The motion has been filed in the High Court to halt interviews scheduled for April 28 by the DPP Nordin Haji.

Through his lawyer Danstan Omari, Memba Ocharo has accused Haji of portraying nepotism in three positions, claiming that the candidates shortlisted for the positions of principal administrative officer, senior supply chain management officer 1, and senior principal finance officer share the same ethnic and religious backgrounds as the DPP.

“The DPP Noordin Haji is in contravention of the Constitution which provides for the guiding principles of leadership and integrity, especially the principle that leaders should not be guided by nepotism or favouritism,” he says in court documents.

He said the actions of the DPP are a violation of articles 72(3) and 232 of the constitution and section 3 and 7 of the leadership and integrity Act.

He asks the court to issue a protective order prohibiting the DPP from conducting interviews, conducting background and/or reference checks, causing gazettement, giving an employment contract, and finally assigning any obligations to the shortlisted applicants for the jobs.

The public service commission has been listed as the second respondent with the speakers of both houses of Parliament, the National Treasury, office of the ombudsman and the EACC.
