Bring it on, Ichung’wah refuses to apologise to Natembeya

National Assembly Majority Leader Kimani Ichung’wah has refused to retract remarks he made against Trans Nzoia governor George Natembeya, which the county boss considers defamatory, and is instead demanding an apology.

Ichung’wah, through his lawyer Andrian Kamotho, says Natembeya as a self pro-claimed villain who is trying to injure his reputation by denying his own words he uttered earlier.
He was replying to a demand letter from Natembeya , who accuses the Kikuyu MP of making defamatory statements touching on him during a funeral service in Kabuchai, Bungoma County on January 3 in relation to abduction cases in the country.
Ichung’wah had claimed that when Natembeya was the Rift Regional County Commissioner in the previous regime, he never took responsiblity for the abduction and killing of people in Kerio Valley, whose bodies were then dumped in River Yala.
“….Wakati mliua watu mkaweka River Yala, you were the Regional County Commissioner in charge of abductions and murdering Kenyans, wewe mwenyewe, shame on you, shame on you, I say again shame on you Governor, you cannot claim abductions when you were the key abductor and murderer of Kenyans in the previous regime….”
Ichung’wah uttered the remarks in presence of Natembeya who was in attendance in that burial.
Rather than retracting the remarks and apologise to Natembeya, Ichun’gwa insists that he is the one who has been defamed and now demands an apology from the governor.
In his letter of reply, he is quotes remarks made by Natembeya back then.
“….na mimi huwa naambia watu kwamba president akiapishwa alipewa katiba, bibilia na akapewa nini? Akapewa panga. Si alipewa sword? Ya kufanya nini?  Ya kukatakata watu na hiyo yote amedelegate kwetu.”
This loosely translates to: “I am telling people, upon swearing in, the president was given the bible, the Constitution and what else? A panga. Wasn’t he given a sword? What for? To butcher and slaughter people. And he has delegated all those powers of slaughtering people to us.”
On another occasion, Ichung’wah quotes him as having saying: “When I talk with my CS in Nairobi, Fred Matiangi, namwambia sir, hamsini wamekufa, na tunataka kubeba. Ama fisi inasherehekea. Haki ya mungu nasema ukweli.”
Based on this, Ichung’wah, through his lawyer, avers that Natembeya’s public service record is tainted with multitudes of vicious crimes and egregious human rights violations.
He further reminds the governor his ‘shoot to kill’ orders to unarmed members of the public and masterminding excesses against innocent citizens when he was a Regional County Commissioner.
He disputes the fact by Natembeya that he has a societal standing locally and internationally.
Ichung’wah insists that “criminal conduct is not subject limitation of time. Time will not sanitise his criminal past.”
He added that the wheels of justice shall eventually roar at his doorstep and there he shall suffer for his actions.
Ichung’wa added that he is a law abiding citizen who is esteemed globally and being entrusted with sacrosanct roles and prominent positions and esteemed mandates in the government.
“It is extremely scandalous for your client to seek attention by wildly associating our client with the hallmarks of evil that depict your client.” Read part of the letter.
Ichung’wah indicates that he spoke the words in broad daylight in the burial procession and the former Regional County Commissioner could be seen smiling and nodding enthusiastically for affirmation since it was fact and there is no way he could say he was defamed in his presence.
Therefore Ichung’wah demands an immediate cessation and give prominent apology for the scandalous, insolent, slanderous and defamatory statements recklessly spewed by Natembeya.
