Baringo father, 42, jailed for defiling eight-year-old daughter
He had visited the victim’s mother under the pretext of taking the child out to buy slippers
A 42-year-old man in Bepyemit Village of Kabartonjo, Baringo County, had been sentenced to 15 years in prison after he was found guilty of defiling his 8-year-old daughter.
In a ruling made at the Kabarnet Law Courts, Senior Principal Magistrate Purity Rugut Koskey said the prosecution, which was led by Counsel Collins Ogutu, proved the case beyond a reasonable doubt.
The prosecution narrated to the court that the offence occurred on multiple occasions in December last year.
The accused, the child’s biological father, visited the victim’s mother under the pretext of taking the child out to buy slippers.
He then spent the night with the minor at his rented residence in Kabartonjo, where the crime was committed.
“The 42-year-old visited the mother of the minor under the pretext of taking the child out to buy slippers. He then spent the night with the minor at his rented residence in Kabartonjo, where the crime was committed,” the prosecution narrated to the court.
Prosecution presented six witnesses, including the minor, and relied on critical medical and forensic evidence that corroborated the allegations and established the offence of incest.
In delivering the sentence, Koskey emphasized the gravity of the crime, referencing both the pre-sentence report and the victim impact statement.
She highlighted the severe psychological harm inflicted on the child and stressed the importance of imposing a strong deterrent to prevent similar offences.
The Office of the Director of Public Prosecution (ODPP) has applauded the ruling, saying it is in line with their mantra of protecting survivors of Sexual-Gender Based Violence (SGBV).
”This conviction reinforces the ODPP’s unwavering commitment to protecting vulnerable members of society and securing justice for survivors of sexual and gender-based violence,” the prosecution stated.
