The high court through Justice John Mativo said the court has no jurisdiction to form the caretaker government that activist Okiya Omtatah was asking for.
The activist had proposed that a caretaker government headed by the chief Justice be constituted so as to enable to conduct the Fresh presidential elections in accordance with the constitution.
He suggested that if not the judiciary NASA and Jubilee should appoint a team to run the caretaker government. The High court has however said that it has no jurisdiction over the formation of a caretaker government.
The high Court had earlier granted the activist an injunction to stop the IEBC from swearing Uhuru Kenyatta after Raila Odinga withdrew from the election.
