The High Court has discharged a suspect linked to the murder of IEBC ICT boss Chris Musando and College Student Maryanne Carol Ngumbu pending investigation.
Justice James Wakiaga freed Andrew Kiprotich Rono who is an accountant at KenGen after the police informed the court that they wished to release him on police bond at the Muthaiga police station where he was being held pending the probe to the alleged murder.
The suspect has been released from custody without being charged. “Police are not interested in holding the suspect any longer,an order for holding the suspect which was issued in a Kiambu court and extended by this court is hereby discharged,” justice James Wakiaga ruled.
The court however referred Kiprotich’s case file back to Kiambu law courts for a mention on October 2, 2017 for further directions but meanwhile the police have been directed to release him from custody in light of the new developments.
Prosecution at the same time wanted an order requiring Kiprotich to report to the homicide section at DCI headquarters in Kiambu, a request prosecution was told to place before the Kiambu court which first issued the detention order.
Lawyer Harun Ndubi who is representing Kiprotich informed the court that he wishes to continue with his application seeking to challenge the detention order on grounds that it was illegal and should not have been issued in the first place.
The court was also informed that a 17 year old girl who was earlier arrested in Migori county in connection with the probe has also been released from police custody back to school.
