Businessman charged with Sh44 million fraud fails to appear in court

A businessman charged with conspiracy to defraud a company Ksh44.3 million failed to appear in court with his lawyer saying he is sick.

Elius Kemboi Korir, trading as Vutaride Company Limited, was supposed to appear at  the Milimani law courts today.
His lawyer, who did not produce any supporting document before the court, told Milimani Chief Magistrate Lucas Onyina that his client fell sick in the morning.
“Your honour my client is not present in court because he is sick. He fell sick today in the morning and he was rushed in the hospital for treatment where the documents are yet to be produced,” the lawyer told the court.
He prayed the court to put his file aside and wait for the documents to be availed where the court opted to give another date for mention.
Kemboi is accused of obtaining Ksh44,370,000 Impala Reel Company Limited.
He was charged that on diverse dates between February 1 and April 1, 2022, at Vutaride Limited office in Westlands area within Nairobi county jointly with others who were not in court conspired to commit the offence.
He was also faced with a charge of obtaining goods by false pretences.
At Vulatide Limited office in Westlands jointly with others with intention to defraud obtained 500 litres of Pramitol 2SE worth Ksh8,250,000 from Impala Reel Company Limited by falsely pretending that it was a genuine supply contract a fact he knew was false.
The court directed the accused to appear in court on January 22, 2025.
Kemboi has three similar matters pending in court where he is out on bond.
