A social media influencer was today charged at the Milimani Law Courts for publishing false information with misleading captions linking it to president William Ruto.
He is accused of sharing an image of a funeral procession implying of the said falsified burial.
David Oaga Mokaya was charged with false publication contrary to section 22 (1) of the Computer Misuse and Cybercrime Act of 2018.
Mokaya, allegedly posted the image on his X (formerly Twitter) account, “Landlord @bozgabi,” on November 13, 2024, claiming it was of the president of Kenya being transported.
It depicted a casket draped in the Kenyan flag and escorted by military officers dressed in ceremonial uniforms and fabricated to give the false impression that it involved the president body leaving Lee Funeral Home.
According to the prosecution, Mokaya falsified the date and other details to give an impression of genuinity.
Appearing before Principal Magistrate Benmark Ekhumbi, Mokaya pleaded not guilty to the charges.
Ekhumbi granted him a Sh100,000 bond or an alternative cash bail of Sh50,000.
The hearing was set for December 4, 2024, where further proceedings will be conducted.
The prosecution emphasised the gravity of the matter as a violation of laws aimed at preventing the spread of disinformation and maintaining public order.
