Former Kiambu county governor Ferdinand Waititu was today released on Sh50,000 personal bond following his arrest yesterday.
Waititu was arraigned in court over allegations of using abusive language during a public rally in Kiambu.
However, he was not formally charged.
The court is set to issue a ruling on whether he will face charges on October 4, 2024.
Waititu failed to take plea to a criminal charge levelled against him by the prosecution after his defence team challenged the effectiveness of the charge sheet.
The defence team led by senior counsel Martha Karua, Njiru Ndegwa, and Aisha Bashir, among others, told Chief Magistrate Lucas Onyina that their client cannot plead to a defective charge sheet.
They said the alleged offence on the face of the charge sheet is an expression made by their client on September 29, 2024 at Ruiru Stadium in Kiambu county.
They said their client told the public rally that Kenyans, who includes boda boda, hustlers, and mama mboga, were cheated during the campaigns to elect Members of Parliament (MPs) and president.
Waititu lawyers said the above information does not amount to criminal offence, but a freedom of expression has outlined in our constitution.
Waititu had further during the rally said that if Deputy President Rigathi Gachagua is impeached the following day, Kenyans through Stephen Kalonzo Musyoka will sponsor a motion to impeach president William Ruto.
The lawyers submitted that their client did not commit an offence that amounts into to criminal indictment.
The trial magistrate directed that Waititu to sign a personal bond of ksh 50,000 to secure his release, pending the ruling on October 4, 2024, which will determine the veracity of the charge sheet.
