A Nairobi Court has ordered unconditional discharge of Boniface Mwangi and other four suspects accused of publishing false information.
The five activists appeared in court on Tuesday, September 3, 2024 where the prosecution requested for additional 14 days to have a miscellaneous file remain active in court to pave way for the police to conclude investigations before charging them.
However, Milimani Law Courts Principal Magistrate Gilbert Shikwe said the prosecution failed to table any evidence to show that they have any intention of having the matter concluded expenditiously.
He therefore released the suspects saying the prosecution did not convince the court that they needed two more weeks to complete their investigations.
“I decline to allow police to continue with the investigations for two or more weeks. I here y release the suspects unconditionally.” The Magistrate said.
The court subsequently ordered that their cash bail be released, which they had been freed on, when they first appeared in court on July 26, 2024.
Boniface was set free alongside Albert Wambugu, Pablo Chacha, Robert Otieno and Erot Franco.
They were accused of publishing false material, unlawful assembly and creating disturbance.
Speaking after their release outside Milimani Law Courts, Mwangi demanded the release of three Kenyans whose whereabouts remain unknown.
The three were allegedly abducted by unknown individuals in Kitengela, Kajiado County.
The three are Bob Micheni, Jamil Longton and Aslam Longton.
Mwangi said he would be marching to the State House to submit a list containing the names of all missing people.
