Three robbery with violence suspects have pleaded with the court to revoke their statements recorded at police station saying they were brutalised to record the statements under duress and therefore have to recant their ealier statements.
The three suspects Antony Wambugu, Yusuf Mwangi Kimotho and Gerald Kangethe Njuguna appeared to court barely walking and informed court that they were dehumanised at the police station where they were forced to record statements after arrest.
Appearing before Milimani Law Courts Magistrate Martha Nazushi, the accused persons denied the charge and they were released on Sh500,000 bond each.
They requested the court to order the police to take them to hospital for treatment.
The court in response to the claims that they were brutalized and forced to record statements, assured them that their statements will not be used as evidence as long as it was not given to a police officer above the rank of an inspector.
They had been charged with robbery with violence contrary to section 296 of the Penal Code.
According to the charge sheet, the three suspects on August 22, 2024 robbed Brian Kasuva Ngitu his original ID card, driving license, Insurance Card and one mobile phone valued at Shj19,000 and during the robbery, they threatened to use actual violence.
The court in cautioning the accused persons informed them that should they plead guilty or upon the hearing of the case should the court convict them, the punishment for their offence is death penalty.
The case will proceed on September 9, 2024.
