A NASA case to stop military deployment to hot spots for next Tuesday’s election has been referred to Chief Justice David Maraga.
Maraga is constitute a three-judge bench to hear it.
High Court Justice Chacha Mwita said the matter raises weighty issues. He allowed Jubilee party to come on board as an interested party.
Once the CJ makes his decision, the matter will be heard on Friday with a view to reaching a verdict before the Tuesday election.
NASA claims the government wants to deploy soldiers to specific areas without Parliament’s approval, an action which would amount to an illegality if not nipped in the bud.
